1. Scope of Application and General Conditions
Jade Escort Agency offers high-class escort services to potential customers through escort models. Jade Escort Agency acts as an intermediary in the sense of direct representation according to Art. 32 of the Swiss Code of Obligations OR. For this purpose, Jade Escort operates the platform www.jade-escort.ch.
When a customer books an escort model at Jade Escort, these terms and conditions become part of the contract between the booked escort model and the customer.
Any person who visits the website www.jade-escort.ch is referred to as a user.
Escort models are referred to as ladies who offer escort services through Jade Escort.
Any person over the age of 18 who enters into a contractual relationship with one or more escort models through the mediation of Jade Escort is referred to as a customer.
These terms and conditions apply exclusively. Conditions that contradict, supplement or deviate from these terms and conditions require the express written confirmation of Jade Escort to be effective.
The user and customer confirm, when using the services and entering into contractual relationships with one or more escort models (bookings), that they fully acknowledge these terms and conditions.
2. Information from Jade Escort
www.jade-escort.ch contains information about escort services.
On www.jade-escort.ch, in advertisements and other promotions (online or print), all information (descriptions, images, films and other information) does not represent any assurances of properties or guarantees of Jade Escort or the corresponding escort model. Jade Escort strives to provide all information and details correctly, completely, up-to-date and clearly, but Jade Escort cannot provide any express or implied guarantee. Solely the respective escort model is responsible for the content of the advertised services and advertising offers.
Jade Escort cannot guarantee that the offered services can be provided.
Jade Escort strives to keep all information on www.jade-escort.ch up-to-date, but cannot guarantee it. All information is provided without warranty and is subject to change at any time without notice.
3. Legal Status of Jade Escort
Jade Escort is a pure mediation agency and acts as a direct representative between the customer and the booked escort model. Jade Escort accepts booking requests on behalf of and in the name of the escort model and coordinates the respective service. Through the mediation of Jade Escort, a contract is concluded between the customer and the escort model, but in no case is a contract concluded between the customer and Jade Escort. Contracts between escort models and customers are concluded directly and at their own responsibility under the conditions agreed with Jade Escort. Jade Escort is in no case a contracting party of contracts concluded between customers and escort models.
Jade Escort, its representatives, employees and assistants are in no way responsible for the offers and advertising placed on www.jade-escort.ch, nor do they bear any liability for any damages resulting from them.
Jade Escort is authorized, but not obliged, to verify the legality or other admissibility of the texts and pictorial representations published on www.jade-escort.ch.
4. Remuneration and Expenses
Jade Escort distinguishes between Premium Rates and Elite Rates, as described on www.jade- escort.ch. The remuneration rates and expense statements published on www.jade-escort.ch at the time of contract conclusion apply.
Special requests by the customer, the execution of which is ultimately decided by the escort model, such as CIM or Greek, will be charged in addition to the rates provided by the escort model. Upon request, Jade Escort will be happy to provide information about these charges.
All remuneration rates are in Swiss Francs (CHF). If the escort model is subject to value-added tax (VAT), the legal VAT will be added to the remuneration.
General travel expenses are charged separately as a flat rate in addition to the remuneration. The minimum booking times defined for each location of service provision and the published remuneration and expense rates at the time of booking on www.jade-escort.ch apply.
Expenses for flight tickets, rental cars, taxis and hotels are charged in addition to the expense flat rates.
Jade Escort acts as a collection agent for the mediated escort models when collecting the remuneration. The escort model has authorized Jade Escort to collect the remuneration and expenses owed by the customer.
5. Conclusion of the Contract
By booking with Jade Escort, the customer makes a binding offer to conclude a contract. If the booking is made via www.jade-escort.ch, the customer will receive an automatic, non-binding booking confirmation after the booking.
A contract between the desired escort model and the customer is only concluded when Jade Escort, on behalf of the booked escort model, expressly confirms the customer's booking in writing (WhatsApp or SMS are sufficient).
The minimum booking time depends on the information published on www.jade-escort.ch. It is one hour within a radius of 50 km from Zurich, two hours for DUO appointments. If the meeting point is more than four hours' drive away, the minimum booking time is eight hours. If the meeting point is only reachable by plane for the escort model, the minimum booking time is 12 hours. For meetings with couples, an additional fee of 30% is charged.
6. Payment
The customer has the following payment options: cash, PayPal, TWINT or bank transfer, with any fees incurred being added to the customer's payment. If a deposit is required, the owed remuneration must be received by Jade Escort no later than one working day before the service is provided. In the case of cash payment, the customer hands over the owed remuneration to the escort model at the beginning of the first meeting.
If the escort model has to travel by plane or the travel distance is more than four hours, a deposit of 40% of the remuneration is owed. This deposit must be received by Jade Escort at the beginning of the journey.
By choosing an online payment method, the customer authorizes Jade Escort to collect the payment for the escort model in the corresponding manner.
In case of non-payment, the booked model is authorized to refuse any service and/or to withdraw from the contract.
7. Rights and Obligations of the Customer
The escort model is available to the customer for the agreed time and ensures that it will be a pleasurable experience. The exact service to be provided is agreed upon in advance between the
customer and Jade Escort. The escort model always acts on its own responsibility and has the right to refuse agreed or newly requested services even after the fact, without any obligation to refund.
In principle, the remuneration is owed for the time spent together and not for individual services. However, special additional services must be agreed upon in advance and are charged separately. The customer will not be given the private contact details of the escort model. The customer undertakes not to contact the booked escort model privately.
8. Preventing and Withdrawing from the Agreement
Both the escort model and the customer have the right to withdraw from the contract at any time and without giving reasons.
If the contract is withdrawn before the service is provided, the customer will be fully refunded the remuneration already paid, minus expenses already incurred up to that point.
If the contract is withdrawn after the service has started and the meeting takes place within a radius of four hours, the customer is obliged to pay a flat rate of CHF 100 for the effort of the escort model and the expenses of Jade Escort. If the meeting takes place outside the radius of four hours, the customer must pay for the time accrued by the escort model up to that point and the actual expenses incurred. If the booked escort model cannot return home on the same day after the customer’s withdrawal, the resulting hotel costs will also be counted as reimbursable expenses.
9. Liability
Jade Escort and the booked escort model disclaim all liability, regardless of its legal basis, as well as claims for damages against Jade Escort and the escort model and any assistants and agents.
In particular, Jade Escort and the escort model are not liable for temporary interruptions in the availability of the website www.jade-escort.ch, for indirect damages and consequential damages, loss of profit or other personal, material and pecuniary damages to the customer and third parties.
A further mandatory legal liability remains reserved, for example for gross negligence or unlawful intent.
Jade Escort uses hyperlinks on www.jade-escort.ch solely for the simplified access of the customer to other web offers. Jade Escort cannot know the content of these web offers in detail and cannot accept liability or other responsibility for the content of these web pages.
Jade Escort cannot make any representations or warranties as to the timeliness, completeness and correctness of the data, as well as the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks and other contents. In particular, no assurances or guarantees are given that the use of the website will not violate the rights of third parties not held by Jade Escort.
10. Confidentiality
Jade Escort and the booked escort model guarantee confidentiality and discretion at all times. Both Jade Escort, its assistants and agents, and the booked escort model undertake to maintain absolute confidentiality and discretion with respect to any information received from and about the customer.
The customer is also obliged to treat any personal information learned from the escort model confidentially.
This obligation also applies after the service has been provided by the escort model and beyond the termination of this agreement.
11. Data Protection
Jade Escort values the protection of personal data of users and providers. Jade Escort takes data protection seriously and ensures appropriate security. Jade Escort processes and maintains personal data in accordance with the provisions of the Swiss Federal Data Protection Act (DSG), the Ordinance to the Federal Data Protection Act (VDSG), the Telecommunications Act (FMG), and, where applicable, other data protection regulations, in particular the General Data Protection Regulation of the European Union (GDPR).
Furthermore, reference is made to the data protection declaration of Jade Escort, which can be viewed on www.jade-escort.ch.
12. Other Provisions
The rights and obligations arising from these terms and conditions are not transferable without prior consent from Jade Escort, the escort model or the respective customer.
Additions, changes or the cancellation of provisions of these terms and conditions are valid only in writing and with the agreement of all contracting parties. This also applies to this written form clause.
In case of force majeure and unforeseen events that are not the responsibility of Jade Escort or the booked escort model and that require a restriction or cancellation of the services, the escort model is exempt from its obligations for the duration of the restriction, and neither Jade Escort nor the escort model can be held liable for any resulting damages.
If individual provisions of these terms and conditions are wholly or partially invalid and/or ineffective, the validity and/or effectiveness of the remaining provisions or parts of such provisions shall not be affected. The invalid and/or ineffective provisions shall be replaced by those that come economically closest to the meaning and purpose of the invalid and/or ineffective provisions in a legally effective manner. The same applies in the event of any gaps in the regulations.
In the event of disputes, Swiss substantive law shall apply exclusively, and the place of jurisdiction is Zurich.
